The labour party chairman in Ogun state, Comrade Abayomi Arabamb has questioned the Independent National Electoral Commission, INEC through the party legal counsel Barrister Hassan Balogun on reasons for denial to inspect electoral materials used for the March 9th governorship election.
According to him, The Motion experte on 2nd of April directing INEC to grant access to labour party to inspect electoral materials used in the governorship election of the March 9th governorship election.
The application was moved on 9th of April 2019 and was granted by the honorable tribunal, immediately the motion was granted, we served the certified true copy of the order to INEC, we subsequently wrote a letter dated 15th of April to INEC requesting that the court order be complied with and by the same letter we requested for a date when the inspection will be carried out and copies of relevant documents would be made in their custody.
Since the 15th of April, till date INEC has refused to grant labour party access to the required documents.
Subsequent to labour party letter dated 15th of April, Hassan Balogun said he put calls through INEC officials at their Abeokuta office, yet they remain unyielding.
Apparently, they have intentionally decided to disobey the order of the honorable tribunal.
Moreso, when the same body (INEC) only desire to grant access to the APM to inspect the same set of documents. We don not know the reason why INEC has decided to merry in content of court but it is clear that they're intention is to frustrate our petition and hinder the court of justice.
"We have advised our client accordingly, and we have their structure to commence content procedures against the Ogun State INEC resident electoral commission and any of his colleagues who are found wanting in that regard."
"We have also consider all our other options, in other to ensure that our client do not suffer or at most mitigate the effect of INEC persistent refusal to grant us access to the relevant electoral materials and further prosecute our client case diligently.said Barr. O.H Balogun."
The legal consequence to the INEC for not complying with court order?
In reaction to this, Barrister Hassan Balogun said, Because the matter is in court, it will be prejudicial to the application for commuter which he intend to file anytime soon, To give an answer to this question.
But all that is apparent is that INEC refusal to comply to the order of the honorable tribunal which was granted on 9th of April 2019 was premeditated.
